Terms of Use

Last updated: 29th September 2026

1. Welcome and Agreement to These Terms

Welcome, and thank you for your interest in Freeater Ltd ("Freeater", "we", "us" or "our").

These Terms of Use ("Terms") govern your access to and use of the Freeater website, mobile applications, content, features, tools and services made available by us, including Freeater Shopping and Freeater Gold (collectively, the "Service").

These Terms form a legally binding agreement between you and Freeater concerning your access to and use of the Service.

If you do not agree with these Terms, you must not use the Service.

You may contact us at info@freeater.com.

2. Acceptance and Eligibility

By accessing or using the Service, you confirm that you have read, understood and agree to be bound by these Terms.

You may only use the Service if:

  • you are at least 18 years old;
  • you have not previously been permanently removed from the Service, unless we have expressly permitted you to return; and
  • your use complies with applicable laws and regulations.

If you use the Service on behalf of an organisation or business, you confirm that you have authority to bind that organisation to these Terms.

3. Changes to These Terms

We may update these Terms from time to time, including where we introduce or change features, change how the Service operates, respond to changes in law or regulation, or make changes to our business.

Where a change materially affects your rights or obligations, we will provide notice where required by applicable law, for example by email or in-app notification.

Updated Terms will take effect from the date stated in the relevant notice or when published, as applicable.

4. Purpose of Freeater

Freeater is a food confidence platform designed to help people discover places and products that may be relevant to their food allergies, intolerances, coeliac disease, dietary requirements, preferences or other dietary needs.

The Service may include features relating to eating out, group dining, food shopping, product scanning, nutritional information, dietary profiles, community content and other food-related information.

Freeater is designed to provide information and an additional helping hand. It does not replace your own checks, professional medical or dietetic advice, information provided directly by a food business or manufacturer, or information displayed on physical food packaging.

5. Medical and Professional Disclaimer

Freeater does not provide medical advice, diagnosis, treatment or professional dietetic services.

Information available through the Service is provided for general informational purposes and should not be treated as a substitute for advice, diagnosis, treatment or care from an appropriately qualified healthcare professional.

Use of Freeater does not create a healthcare professional-patient relationship.

You should seek appropriate professional advice concerning medical conditions, allergies, intolerances, coeliac disease or other health-related dietary requirements.

If you believe you are experiencing a medical emergency, seek immediate medical attention or call 999.

6. Geographic Availability

The Freeater mobile application is currently available to download in the United Kingdom only.

The Service is primarily intended for users in the United Kingdom and is provided with UK users, laws and requirements in mind.

Although some content, food businesses or product information available through the Service may relate to locations outside the UK, this does not mean that the Freeater mobile application is officially available or intended for use in those locations.

We do not guarantee that the Service, its content or any particular feature is appropriate, available or compliant with laws outside the United Kingdom.

If you access or continue to use the Service while outside the United Kingdom, you are responsible for ensuring that your use complies with any applicable local laws.

FREEATER SHOPPING

7. Freeater Shopping

Freeater Shopping allows users to scan or search for food products and receive information based on product information available to Freeater and the dietary requirements or preferences selected within their Freeater profile.

Freeater Shopping is intended to provide an additional helping hand when checking products. It must not replace your own checks or be used as the sole basis for deciding whether a product is safe or suitable for you.

8. Accuracy and Checking Products

Freeater Shopping can make mistakes.

Results may be inaccurate, incomplete, outdated, unavailable or incorrectly interpreted. We do not guarantee that every ingredient, allergen, dietary requirement, nutritional characteristic or potential suitability issue will always be identified.

Product ingredients, recipes, formulations, manufacturing processes, allergen information, precautionary statements, nutritional information and packaging can change, including without notice to Freeater. Different versions of the same product may also exist at the same time.

Product information may originate from manufacturers, retailers, suppliers, external databases, users or other third parties. Although we may review, process or supplement information used by the Service, we cannot guarantee that third-party information is complete, accurate or current.

A product being displayed as suitable, or the absence of an identified issue, does not guarantee that a product is safe or suitable for you. Similarly, if Freeater cannot find, recognise or fully assess a product, this must not be interpreted as confirmation that the product is suitable.

Before making a final decision to consume a product, you must always check the physical product and packaging yourself, including, where relevant:

  • the ingredients list;
  • allergen information;
  • precautionary allergen statements and warnings;
  • dietary or suitability information; and
  • any other information relevant to your individual requirements.

Where appropriate, you should contact the manufacturer directly or seek appropriate professional advice.

You are responsible for ensuring that the dietary requirements and preferences selected within your Freeater profile accurately reflect the requirements you want the Service to consider and for keeping that information up to date.

We are continually working to improve Freeater Shopping, including its technology, accuracy and product coverage. However, we cannot guarantee that every product will be covered or that the Service will be error-free.

9. Scan History

Freeater may allow you to view products you have previously scanned.

Scan history is provided for convenience and reflects information available at or around the time of the relevant scan.

You must not rely on a previous scan result as confirmation that a product remains suitable for you. Products and their ingredients, recipes, allergen information and packaging may change.

Before consuming a product, you should check the current product and its packaging and, where appropriate, scan it again.

The warnings and responsibilities set out above apply each time you use or refer to a Shopping result.

10. Product Submissions

Where a product is not available through Freeater, we may allow users to submit product information to help improve product coverage.

You must provide information accurately and in good faith and must not knowingly submit false, misleading or inaccurate product information.

Submitting a product does not mean that Freeater has verified, approved or confirmed the product or its suitability for any dietary requirement.

Submitted information may be reviewed, processed, supplemented or otherwise used to operate and improve Freeater Shopping and its product coverage, subject to these Terms and our Privacy Policy.

FREEATER GOLD AND SUBSCRIPTIONS

11. Free Shopping Access

Freeater may provide users with a limited number of free Shopping scans or other free access to allow them to try Freeater Shopping.

The amount of free access available will be displayed within the Service and may change from time to time.

Unless expressly stated otherwise, free scans or trial access are provided once per user and do not automatically reset or renew.

Free scans have no cash value and cannot be transferred, exchanged or sold.

You must not create or use multiple accounts, false identities or other methods to obtain additional free scans or trial access.

12. Freeater Gold

Freeater Gold is a paid premium subscription which provides access to additional features, including unlimited Shopping scans for normal personal use, subject to these Terms and our fair-use and anti-abuse measures.

Freeater Gold may be offered through monthly, annual or other subscription plans.

The current price, billing period and features included with each available plan will be displayed within the Service before you subscribe.

Where you purchase Freeater Gold through an app store or another third-party payment provider, your payment and subscription may also be subject to that provider's terms.

Features included within Freeater Gold may be developed, updated or improved as the Service develops, subject to your rights under applicable consumer law.

13. Subscription Renewal and Cancellation

Freeater Gold is a recurring subscription.

Before subscribing, you will be shown the applicable price and billing period.

Unless you cancel before renewal, your subscription will renew for the applicable billing period at the applicable subscription price, subject to any price changes notified to you in accordance with applicable law and the terms of the relevant payment provider.

You may cancel your Freeater Gold subscription at any time through the cancellation method provided by the platform or payment provider through which you subscribed.

Cancellation prevents your subscription from renewing for another billing period.

Unless applicable law or the relevant payment provider requires otherwise, you will continue to have access to Freeater Gold until the end of the billing period you have already paid for.

Cancellation does not automatically entitle you to a refund for the remaining part of an existing billing period. Nothing in these Terms affects any refund, cancellation or other rights you have under applicable consumer law or the rules of the relevant payment provider.

14. Price Changes

We may change the price of Freeater Gold from time to time.

Where required, we will provide appropriate notice before a price change applies to an existing subscription.

Price changes will be implemented in accordance with applicable law and, where relevant, the rules of the app store or payment provider through which the subscription was purchased.

15. Fair Use and Anti-Abuse

Freeater Gold provides unlimited Shopping scans for normal personal use.

"Unlimited" does not permit automated, fraudulent, abusive or commercial use, bulk data collection, systematic extraction of product information or other activity inconsistent with the Service being provided for an individual's normal personal use.

Unusually high, automated or otherwise potentially abusive activity may result in a temporary restriction while we review the activity.

Where we are satisfied that activity represents legitimate personal use, we may restore access. We may maintain appropriate restrictions where we reasonably believe the Service is being misused.

You must not:

  • use bots, scripts, automated systems, scraping tools or similar technologies to perform scans or interact with Shopping;
  • systematically extract, scrape or collect Freeater product information;
  • use Shopping primarily for commercial or bulk data-collection purposes without our written permission;
  • create or use additional accounts to circumvent free-access or fair-use controls;
  • share accounts for the purpose of circumventing restrictions; or
  • interfere with or attempt to bypass technical, security or anti-abuse measures.

We may provide free, discounted or promotional Gold access from time to time. Such access may be subject to additional eligibility requirements, durations or conditions displayed as part of the relevant offer.

REFERRALS AND PROMOTIONS

16. Referral Codes

Freeater may provide referral codes, promotional codes, rewards or similar offers from time to time.

Unless expressly stated otherwise, referral codes are intended to be redeemed by the person or party for whom the referral is genuinely intended.

Referral codes must not be abused, manipulated, sold, fraudulently distributed or used in a manner inconsistent with the relevant offer.

You must not create multiple accounts, make false referrals, refer yourself through additional accounts or identities, or otherwise manipulate a referral programme to obtain benefits improperly.

We may refuse, cancel or revoke a referral, reward, discount or other benefit where we reasonably believe that a referral or promotion has been misused or obtained fraudulently.

Specific promotions may be subject to additional terms presented with the offer.

USER ACCOUNTS

17. Accounts and Security

Certain features require you to create an account.

You agree to provide accurate, complete and up-to-date information and update it where necessary.

You are responsible for maintaining the confidentiality and security of your login credentials and must not knowingly allow an unauthorised person to access your account.

You may not create an account using a false identity, impersonate another person or register using another person's information without permission.

If you believe your account has been compromised, please notify us at info@freeater.com.

18. One Account Per User

Unless otherwise approved by us in writing, each individual may register only one Freeater account.

Multiple accounts must not be created or used to circumvent free access, referral rules, fair-use controls, subscription requirements or other restrictions.

19. Closing Your Account

You may request to close your Freeater account using any account-deletion functionality we provide or by contacting info@freeater.com.

Deletion or retention of associated personal data will be handled in accordance with our Privacy Policy and applicable law.

Closing your Freeater account does not necessarily cancel a subscription purchased through a third-party app store or payment provider. Where applicable, you must separately cancel your subscription using the cancellation method provided by that platform.

INTELLECTUAL PROPERTY

20. Ownership and Licence

We are the owner or authorised licensee of intellectual property rights in the Service, including software, source code, databases, functionality, designs, text, graphics, photographs, audio, video, trademarks, logos and other content ("Content").

These rights are protected by applicable intellectual property laws.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable and revocable licence to access and use the Service for your personal, non-commercial use.

No ownership rights are transferred to you.

21. Restrictions

Unless expressly permitted by these Terms or by us in writing, you must not copy, reproduce, republish, distribute, sell, license, commercially exploit, reverse engineer or otherwise misuse the Service, Content or Freeater brand assets.

If you wish to use our Content or intellectual property beyond the uses permitted by these Terms, contact info@freeater.com.

All rights not expressly granted are reserved.

USER CONTENT AND COMMUNITY INFORMATION

22. User Content

The Service may allow you to submit reviews, photographs, videos, comments, reports, product information, suggestions or other material ("User Content").

You remain responsible for User Content you submit and confirm that you own it or have the rights, permissions and consents necessary to submit it.

By submitting User Content, you grant Freeater a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, distribute and otherwise use that content as reasonably necessary to operate, provide, promote and improve the Service, subject to our Privacy Policy and applicable law.

23. Content Standards and Moderation

You must not upload, post or submit User Content that:

  • is unlawful, fraudulent or knowingly false or misleading;
  • is hateful, discriminatory or promotes unlawful discrimination;
  • contains harassment, bullying, threats, intimidation or abuse;
  • is defamatory;
  • is obscene, sexually explicit or otherwise seriously offensive or inappropriate;
  • encourages violence, self-harm or other harmful or unlawful behaviour;
  • infringes another person's intellectual property, privacy or other legal rights;
  • contains another person's personal or confidential information without appropriate permission;
  • impersonates another person or misrepresents your identity or relationship with a person or business;
  • contains spam, scams or unauthorised commercial or promotional material;
  • deliberately provides false or misleading information concerning allergens, ingredients, dietary suitability, food safety or another matter which could reasonably create a risk to another user; or
  • otherwise breaches these Terms or applicable law.

We are not required to monitor all User Content before it is published.

Where we become aware of User Content that we reasonably believe breaches these Terms, is inappropriate for the Service or could cause harm to users or third parties, we may review, restrict, hide or remove that content.

We may warn, restrict, suspend or terminate the account responsible where appropriate, particularly in cases of repeated or serious violations.

Users may be provided with tools to report content they believe breaches these Terms.

The fact that User Content remains available through the Service does not mean that Freeater endorses, verifies or approves it.

24. Community Reviews

Reviews, comments, photographs, videos and other community-generated information represent the experiences, views or opinions of the users who submit them.

Unless expressly stated otherwise, Freeater does not independently verify every claim contained within community content.

Community content should not be treated as verified food-safety, allergen, medical or professional dietary advice.

You should make your own checks and communicate your requirements directly to the relevant food business where appropriate.

25. Feedback

If you voluntarily provide ideas, suggestions or feedback concerning Freeater, we may use that feedback to develop, operate and improve the Service without an obligation to compensate you.

This does not transfer ownership of material or intellectual property that you already owned before providing the feedback.

EATING OUT AND FOOD BUSINESS INFORMATION

26. Eating Out and Food Business Information

Information concerning eateries and other food businesses, including menus, ingredients, allergens, dietary suitability, dietary options, allergen practices, facilities, opening information, hygiene ratings and other business information, may originate from food businesses, government bodies, users or other third parties.

Information may change and Freeater cannot guarantee that all information displayed is complete, accurate or current.

Where a food business provides information to Freeater, manages or claims a business profile, or has a commercial, Partner or other relationship with Freeater, the food business is responsible for ensuring that the information it provides or maintains through the Service is accurate, complete and kept up to date.

This includes information concerning allergens, ingredients, dietary requirements, dietary suitability, menus, food preparation practices and other information that could reasonably affect a user's decision about whether food or a venue may be suitable for them.

Food businesses must update information they control through Freeater promptly where it changes and must not knowingly provide false, inaccurate, incomplete, outdated or misleading information.

A Freeater Partner or other badge, designation or commercial relationship does not remove a food business's responsibility for the information it provides and does not constitute a guarantee by Freeater that a particular food, menu item or venue is safe or suitable for an individual.

Nothing in a food business's relationship with Freeater transfers that business's legal responsibilities concerning food safety, allergens, consumer information or other applicable requirements to Freeater.

Users should always communicate their allergies, coeliac disease, intolerances or other relevant dietary requirements directly to the food business before ordering or consuming food.

27. Food Hygiene Ratings

Where Freeater displays a food hygiene rating or similar official information, that information may originate from the relevant government authority, official database or another authorised source.

Freeater does not determine the underlying official hygiene rating.

Ratings may change and there may be a delay before updated information is reflected within the Service. Users may consult the relevant official source for the latest official information.

28. Third-Party Links and Services

The Service may contain links to or integrations with third-party websites, services, businesses or platforms.

These third parties operate independently from Freeater.

Any transaction or interaction with a third party is between you and that third party and may be governed by its own terms and privacy policies.

We do not control and are not responsible for third-party websites, services, products or content.

PROHIBITED CONDUCT

29. Prohibited Activities

You must not:

  • use the Service for an unlawful purpose or violate applicable laws or regulations;
  • harass, threaten or harm others;
  • infringe another person's rights;
  • impersonate another person or gain unauthorised access to an account or system;
  • engage in fraud;
  • bypass, interfere with or tamper with security or technical measures;
  • reverse engineer the Service except where applicable law expressly permits it;
  • use unauthorised bots, crawlers, scripts, scraping systems or automated tools;
  • introduce malware or otherwise disrupt the Service;
  • collect information about other users without lawful authority;
  • sell, transfer or commercially exploit access to the Service without our permission;
  • misuse free access, subscriptions, referral codes, promotions or rewards;
  • knowingly provide false, inaccurate or misleading business, menu, allergen, dietary or product information; or
  • assist another person in carrying out prohibited activity.

Violations may result in restrictions, suspension or termination of access.

SERVICE AVAILABILITY AND DISCLAIMERS

30. Service Availability and Accuracy

We are continually developing and improving Freeater. Features may be introduced, changed, updated, restricted or discontinued from time to time, subject to applicable consumer law.

We do not guarantee that every feature, product, eatery, barcode or item will always be available.

The Service may occasionally be unavailable because of maintenance, technical problems, third-party services, connectivity issues or other circumstances beyond our reasonable control.

To the extent permitted by applicable law, the Service is provided "as is" and "as available".

Although we work to improve the quality and accuracy of Freeater, information displayed through the Service may contain errors, omissions or outdated information.

You remain responsible for carrying out appropriate checks before making decisions based on information available through the Service.

Nothing in these Terms excludes warranties, guarantees or rights that cannot lawfully be excluded.

31. Nutrition Information

Any nutritional information or nutritional overview provided through Freeater is for general informational purposes.

It does not constitute personalised nutritional, dietetic or medical advice and should not be used as a substitute for advice from an appropriately qualified professional.

Nutritional information may be derived from product or third-party information and may contain inaccuracies or change over time.

LIABILITY

32. Limitation of Liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so or affects rights that cannot lawfully be excluded or limited.

Subject to those rights and to the fullest extent permitted by law, Freeater will not be liable for indirect or consequential losses arising from your use of, or inability to use, the Service where such losses were not reasonably foreseeable.

Where permitted by law, Freeater's total liability to you for claims arising from the Service will not exceed the greater of:

(a) the amount you paid to Freeater during the 12 months immediately preceding the event giving rise to the claim; or

(b) £100.

Nothing in these Terms affects your statutory rights, including rights that may arise under the Consumer Rights Act 2015.

33. Your Responsibility When Making Food Decisions

Freeater is an informational and decision-support tool and food-related decisions may involve individual circumstances that Freeater cannot independently verify.

You are responsible for performing the final check before consuming a food product and for communicating your dietary requirements directly to food businesses where appropriate.

The Service should not be used as the sole basis for deciding whether a food is safe or suitable for you.

SUSPENSION AND TERMINATION

34. Suspension and Termination

We may reasonably restrict, suspend or terminate access to all or part of the Service where:

  • you materially breach these Terms;
  • we reasonably suspect fraud, abuse or unlawful activity;
  • your use creates a material security risk;
  • you attempt to circumvent technical, subscription, fair-use or anti-abuse measures; or
  • doing so is reasonably necessary to protect Freeater, its users or third parties.

Where appropriate and reasonably practicable, we may provide notice or an opportunity to resolve the issue.

If your account is terminated, your licence to use the Service ends.

Provisions which by their nature should continue after termination, including provisions relating to intellectual property, liability and rights accrued before termination, will survive.

Nothing in this section affects your statutory rights.

PRIVACY

35. Privacy Policy

Our Privacy Policy explains how we collect, use, store and otherwise process personal data.

Please read it carefully at www.freeater.com/privacy-policy.

The Privacy Policy applies alongside these Terms.

APP STORES AND THIRD-PARTY PLATFORMS

36. Apple App Store

Where you download, access or use Freeater through the Apple App Store or on an Apple device, you acknowledge that these Terms are between you and Freeater, not Apple Inc. ("Apple").

Apple is not responsible for the Service or its content and has no obligation to provide maintenance or support for Freeater, except to the extent required under Apple's applicable terms or applicable law.

You must comply with applicable Apple terms when downloading, purchasing or using the Service.

Where applicable, Apple and its subsidiaries may be third-party beneficiaries of these Terms and may enforce applicable provisions against you.

37. Google Play Store

Where you download, access or use Freeater through Google Play or on an Android device, these Terms are between you and Freeater, not Google LLC ("Google").

Your use of Google Play is also subject to Google's applicable terms and policies.

Purchases and subscriptions made through Google Play may be processed and administered by Google and may therefore also be subject to Google's applicable billing, cancellation and refund policies.

38. App Store Purchases and Refunds

Subscriptions and other purchases made through the Apple App Store, Google Play or another authorised third-party payment provider may be processed by that provider.

Billing, payment, subscription management, cancellation and refunds may therefore also be governed by the relevant provider's terms and policies.

Where you purchase Freeater Gold through a third-party platform, you may need to manage or cancel the subscription through that platform.

Where permitted by applicable law and Apple's applicable policies, information concerning your use of purchased content may be provided to Apple for the limited purpose of processing or assessing refund requests. Any sharing of personal data will be handled in accordance with our Privacy Policy and applicable data protection law.

Nothing in these Terms limits your statutory rights.

GENERAL TERMS

39. Force Majeure

We are not responsible for failure or delay in performing an obligation where caused by circumstances beyond our reasonable control, subject to any rights you have under applicable consumer law.

40. Additional Terms

Certain features, promotions or areas of the Service may be subject to additional terms, policies or rules displayed when you use them.

Those additional terms form part of your agreement with us where applicable.

If additional terms conflict with these Terms, the terms specifically applicable to the relevant feature or promotion will apply to the extent of that conflict, unless otherwise stated.

41. Entire Agreement

These Terms, together with our Privacy Policy and any applicable Additional Terms, constitute the agreement between you and Freeater concerning your use of the Service.

42. Assignment

You may not transfer your rights or obligations under these Terms without our prior written consent.

We may transfer our rights or obligations where permitted by applicable law. Where required by law, we will notify you of such a transfer.

43. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect.

44. No Waiver

If we do not immediately enforce a provision of these Terms, this does not mean that we waive our right to enforce it later.

45. Electronic Communications

Where permitted by applicable law, communications relating to the Service may be provided electronically, including by email or in-app notification.

46. Governing Law and Disputes

These Terms are governed by the laws of England and Wales.

If you are a consumer, you retain any mandatory rights you have under applicable consumer law, including rights relating to where legal proceedings may be brought.

We encourage you to contact us first if you have a complaint or dispute so that we can try to resolve the matter.

Nothing in these Terms prevents either party from exercising any right or remedy available under applicable law.

47. Support

We may provide customer support in relation to the Service.

Unless required by applicable law, we do not guarantee that support will be continuously available or that every query will be resolved within a particular period.

  • use bots, scripts, automated systems, scraping tools or similar technologies to perform scans or interact with Shopping;
  • systematically extract, scrape or collect Freeater product information;
  • use Shopping primarily for commercial or bulk data-collection purposes without our written permission;
  • create or use additional accounts to circumvent free-access or fair-use controls;

  • is unlawful, fraudulent or knowingly false or misleading;
  • is hateful, discriminatory or promotes unlawful discrimination;
  • contains harassment, bullying, threats, intimidation or abuse;
  • is defamatory;
  • is obscene, sexually explicit or otherwise seriously offensive or inappropriate;
  • encourages violence, self-harm or other harmful or unlawful behaviour;
  • infringes another person's intellectual property, privacy or other legal rights;
  • contains another person's personal or confidential information without appropriate permission;
  • impersonates another person or misrepresents your identity or relationship with a person or business;
  • contains spam, scams or unauthorised commercial or promotional material;

  • use the Service for an unlawful purpose or violate applicable laws or regulations;
  • harass, threaten or harm others;
  • infringe another person's rights;
  • impersonate another person or gain unauthorised access to an account or system;
  • engage in fraud;
  • bypass, interfere with or tamper with security or technical measures;
  • reverse engineer the Service except where applicable law expressly permits it;
  • use unauthorised bots, crawlers, scripts, scraping systems or automated tools;
  • introduce malware or otherwise disrupt the Service;
  • collect information about other users without lawful authority;
  • sell, transfer or commercially exploit access to the Service without our permission;
  • misuse free access, subscriptions, referral codes, promotions or rewards;

  • you materially breach these Terms;
  • we reasonably suspect fraud, abuse or unlawful activity;
  • your use creates a material security risk;
